Escrow Service Terms of Use
1. Introduction
- 1.1 These Escrow Service Terms of Use of P2P.ARMY ("Terms") govern your access to and use of the Escrow account functions on the P2P.Army website. These Terms also include our "Privacy Policy" and "General Terms of Use of P2P.Army".
- 1.2 The terms "We", "Us", and "Our" also refer to P2P.ARMY.
- 1.3 The term "You" refers to the person using the Platform.
- 1.4 The term "Parties" refers to both "Buyer" and "Seller".
- 1.5 The term "Buyer" refers to a person who purchases a product or service.
- 1.6 The term "Seller" refers to a person who sells a product or service.
- 1.7 The term "Support", "Manager", or "Escrow Manager" refers to an employee of P2P.Army who can advise the Parties and resolve disputes.
- 1.8 The term "Chat" refers to the P2P.Army chat which is located on the website https://p2p.army.
- 1.9 The term "Escrow Account" refers to the cryptocurrency account to which the Buyer transfers crypto assets. The crypto assets are held until the Seller fully fulfills the terms of the deal, which are then transferred to the Seller after the deal is successfully completed.
- 1.10 Please read these Terms carefully. They contain important information about your rights, including limitations of liability for P2P.ARMY and certain third parties and disclaimers of warranties. Each time you access the Service by any means (e.g., via the Internet or on a mobile device), you irrevocably agree to comply with the version of the Terms published on the Platform at the time of accessing the Platform. You are not allowed to use the "Escrow Accounts" service if you do not agree with these Terms.
2. Communications
- 2.1 The Buyer or the Seller (the Parties) can consult with Support at any stage through the Telegram app, or Email, which are indicated on the page https://p2p.army/ru/contacts. In case of a dispute, communication is carried out in the Chat on P2P.Army.
- 2.2 The Parties cannot consult with Support in private chats of Escrow Managers or through contacts that are not listed on the page https://p2p.army/ru/contacts.
- 2.3 The Parties agree on the terms of the deal through personal communications, in person, or via any other applications.
- 2.4 The Parties carry out important communication in the P2P.Army Chat, necessarily describing and confirming the terms of the Escrow deal clearly, such as: detailed service or product descriptions, guarantees, and cancellation terms.
- 2.5 The Parties may communicate when transferring the product or performing the service outside P2P.Army.
3. Obligations of the Parties
- 3.1 The Parties must stay in contact with the Escrow Manager of P2P.Army by responding through the internal P2P.Army Chat.
- 3.2 The Parties must complete the Escrow deal within the deadline. If one of the Parties cannot complete the Escrow deal in time and the other Party is not opposed, then by mutual agreement, the deal period can be extended.
- 3.3 The Parties must describe all changes to the Escrow agreements in the P2P.Army Chat.
- 3.4 The Parties must not transfer money to each other outside the P2P.Army Escrow Account indicated on the website https://p2p.army in your personal account. All transfers must be made through the P2P.Army cryptocurrency Escrow Account. Even when the Escrow Manager asks you to transfer assets to another wallet.
- 3.5 All Parties must behave respectfully towards each other, refrain from using inappropriate language, and avoid offensive statements.
4. Obligations of the Seller
- 4.1 The Seller must not rush or ask the Seller to press the "Finish Deal & Pay" button.
- 4.2 The Seller must describe or upload the escrow agreements in the form of a file in the P2P.Army Chat and specify the cancellation terms.
- 4.3 The Seller must not deliver the Product or perform the Service until the Buyer confirms the Seller's terms.
- 4.4 The Seller must not deliver the Product or perform the Service until the Buyer reserves funds in the cryptocurrency Escrow Account and the deal status changes to "Data/Service Transferring".
- 4.5 The Seller must not deliver the Product or perform the Service until ensuring the claimed crypto assets are present on the cryptocurrency Escrow Account through a blockchain explorer.
- 4.6 The Seller must fully deliver the Product or Services to the Buyer as specified in the escrow agreements.
- 4.7 When delivering the Product or performing the Service, the Seller should independently gather all evidence of delivery, including taking photos, videos, screenshots, and recordings. This will help protect the Seller in case of a dispute.
- 4.8 The Seller should remain in personal contact with the Buyer, even after the deal is completed, as the Buyer may have questions later on.
5. Obligations of the Buyer
- 5.1 The Buyer must review the terms of the deal, the guarantees of execution, and the conditions for canceling the deal provided by the Seller. After reviewing, write in the Chat the message "I agree with all terms.". If the Buyer wants to change any terms, they must write about it in the Chat and wait for a positive response from the Seller.
- 5.2 Upon receiving the Product or Service, the Buyer should independently gather all evidence of delivery, including taking photos, videos, screenshots, and recordings. This will help protect the Buyer in case of a dispute.
- 5.3 After 100% receiving the Product or Service, the Buyer should complete the deal and send the money to the Seller through the P2P.Army service.
6. Dispute of a Deal
- 6.1 A deal may be disputed by the Buyer or Seller if the terms described in the deal are violated during the delivery of goods or services.
- 6.2 If the Parties cannot reach an agreement, one of the Parties files a claim to the Escrow Manager in the P2P.Army Chat. The Escrow Manager should join the chat, within a few hours or days review the presented information, and offer resolution options.
- 6.3 If the Parties do not accept the Escrow Manager's proposals, the Parties will be given a pause for consideration for several days.
- 6.4 If the Parties cannot resolve the dispute over an extended period, the Escrow Manager will make a final decision on the deal, which cannot be contested. The Escrow Manager may distribute the reserved assets in the following ways: 1 – transfer to the Seller, 2 – return to the Buyer, 3 – split evenly, 4 – in complex cases, resolve the dispute with individual division of funds if one of the Parties does not mind.
7. P2P.Army Liability for Escrow Accounts
- 7.1 We are not responsible for accidentally pressing the "Complete and Send Money" button to the Seller.
- 7.2 We are not responsible for incorrect listings of wallets intended for receiving or returning funds by the Parties.
- 7.3 We are not responsible for incomplete escrow agreements by the Parties, which could have led to a negative decision by the Escrow Manager.
- 7.4 We are not liable for any indirect or incidental losses (lost profits, damages, etc.) related to the technical operation of the website, servers, networks, etc.
- 7.5 We are not responsible for any losses incurred by one of the parties.
8. Changes to these Escrow Terms of Use
- 8.1 We may revise these Terms from time to time without prior notice. You must comply with any changes to these Terms following the publication of such changes in the Service. You should frequently check these Terms to ensure you are familiar with the most recent version of the Terms.
9. General
- 9.1 Considering the international nature of deals through the "Escrow Account", the Parties agree not to subject this Agreement to any specific national legal law. Instead, the relationships between the Parties are regulated solely by the terms set out in these conditions. If the terms are insufficient, the Parties will be guided by logic, common sense, and generally accepted practices in the field of online deals, as well as taking into account all negotiations, correspondence, provided documentation, and any other information.
- 9.2 The Parties agree to all points of the "Escrow Account" Terms of Use and will agree with any decision of the Escrow Manager of P2P.Army when disputing deal.
- 9.3 We may refuse to use our Escrow service if there are complaints about you, you are caught in fraud, or engage in illegal activities.
